An NYPD cop on Thursday told the court that Chris Simms was “like a zombie” and reeked of marijuana when he was pulled over after making a “wild turn”. Chris Simms, who is 29 and son of Giants legend Phil Simms, pleaded not guilty at the pre-trial hearing to driving while stoned.
Simms was busted at a DWI checkpoint after making a wild turn onto W. Houston St. early in the morning. Simms’s wife Danielle was riding shotgun and was eight months pregnant at the time.
Acosta said Simms told him, “I smoked everything before” and that “He had four puffs” when asked where the marijuana was.
The hearing will determine whether what Simms told the officers at the checkpoint will be admissible. Prosecutors played a video of Simms looking tired and refusing to take tests in the 7th Precinct. Simms’ lawyers argued police didn’t have probable cause to arrest the quarterback.
That is crazy considering they smelt the marijuana on Simms at the checkpoint before obtaining questions. If were going to have a law shouldn’t everyone follow it including celebrities and police officers? I think everyone should, but if we could just legalize it none of this would even matter.
Simms could face up to a year in jail and a $1,000 fine if convicted of operating a motor vehicle while under the influence of drugs. His license has been suspended due to the fact he refused to submit to a drug test.
